The following license (hence forth known as the License) applies to any and all software, games, programs, code, web pages, graphics, ideas, etc... (hence forth known as Information) available on the domain Mikeware.com and http://www.cafepress.com/Mikeware (for cafepress.com, only Mikeware™ specific Information applies, all other content is subject to cafepress.com's policies).

Applications: This license applies to any person, machine, or thing (hence forth known as the User) downloading, obtaining, using, and/or viewing (hence forth known as accessing) the Information on Mikeware.com. By accessing Mikeware Information the User agrees to this license.

Distribution: Mikeware™ retains all rights, copyrights, trademarks, and ownership (hence forth known as Rights) to its Information including Names, Characters, Content, Graphics, Stories, Unique Interfaces, and Ideas of that Information. The User agrees not to distribute in any manor any Information accessed (knowingly or unknowingly) on Mikeware.com, unless otherwise specified in official Mikeware™ documentation as an alternative license for a specific product.

If any Information is illegally distributed in any manor, the distributor acknowledges all responsibility for said actions. The distributor, if proved guilty, agrees to pay whatever fees as required by law in addition to an estimated damage charge by Mikeware™. In such an event, this License shall not be invalidated and still applies hence forth in its distribution.

"Hot" Linking: "Hot" Linking or linking directly to Information on Mikeware.com from another website, device, machine, server, etc. is prohibited except in the below circumstances. Linking to "http://www.mikeware.com/" alone shall always be allowed. Linking to any main page directly available off of "http://www.mikeware.com/" shall also be allowed, this includes News, Projects, Legacy, Shop, and About. Also, any sub-domain may be linked, for example: "http://sub-domain.mikeware.com/."

Personal bookmarks (available only on one machine to one person) to Information available on Mikeware.com are perfectly acceptable; however, please refer to the "Mature Content" section for more information.

Search Engines linking to content on Mikeware.com cannot be controlled from the manner stated above; however, this license still applies to any User accessing Mikeware™ Information from said Search Engine Interface and such content available in said manner falls under the requirements of this license; noticeably the Distribution section.

Legacy: Mikeware™ Legacy Information (including Software, see Applications) is any Information found under the Mikeware™ Legacy page. Legacy Information is not "freeware" and is NOT freely distributable.

The Mikeware™ Legacy is provided as a service to help the User understand Mikeware's roots. Mikeware™ no longer guarantees the quality or reliability of Legacy Information; however, this Information still falls under the category of this license as Mikeware™ still retains all Rights (see Distribution). 

Legacy Support: Mikeware™ no longer guarantees the support of said Legacy Information. The User may request technical assistant about Mikeware's Information above and beyond what is printed on Mikeware.com; however, no response or application of request is guaranteed in any circumstance.

Support: Mikeware™ will support any current (non-legacy) software and Information via E-mail correspondence; however, please view any online documentation and FAQs before doing so. Unfortunately, telephone and mail correspondence are not available at this time.

Reliability: Mikeware™ strives for reliable and quality in it's Information; however, the User takes full responsibility in its use. The User agrees to free reliability and responsibility from Mikeware™ upon anything that may happen to the User or their Machine upon the use of Mikeware's Information.

Mikeware.com: Mikeware™ does NOT collect User's private information (Name, IP Address, E-mail Address, etc...) (hence forth known as User Information) for financial gain. Mikeware.com does not track any User Information on it's website; however, the Servers hosting Mikeware.com do retain IP Addresses and Browser Information for statistical purposes. This Server Information is only viewed by Mikeware™ employees and is used in the upkeep of Mikeware.com only. The Server Information has no way of being identified to any specific User. It is not sold or used in any other way.

Software/Information: Mikeware's games may use Mikeware.com as a gateway or interface with other machines directly for multiplayer online play; however, no User Information is ever taken or used from your computer without your prior consent.

E-mail: Any E-mail correspondence with Mikeware™ remains private and E-mail addresses are never used for any purpose other than responding to your questions/comments. Mikeware™ may send follow-up requests to ask for permission to publish User comments. If the User wishes to do so Anonymously, with an abbreviated name, or never be asked again they may respond as such.

Newsletters: The User may sign-up for Mikeware.com Newsletters, by doing so they give Mikeware™ permission to E-mail them the requested information. Any such Newsletter lists adhere to this Privacy Policy and will not be sold. A User may request at any time to be removed from such lists and allow for a reasonable time period for their removal to occur.

Unusual Circumstances: In the case that Mikeware™ is sold, Mikeware™ as part of the sales agreement will require that current User Information remain in accordance to this license.

In the event Mikeware™ goes bankrupt and is sold off without our direct involvement, the longevity of this license cannot be guaranteed.

In the event of legal involvement / cases, Mikeware™ may be required by law to give up User Information. Unfortunately, we shall have no choice and any information given in this manor will than be in the hands of the legal system and apply to any "privacy policy" they may or may not have.

In the event that this license is changed, the Privacy Policy will be guaranteed to still maintain the User's Information privacy as mentioned above in similar fashion.

Some Mikeware™ Information may be explicitly labeled as "Mature Content" or "Mature Audiences Only." Such areas, will be guarded by an extra agreement screen listing this part of the license and linking to this license in full, explicitly. By clicking "I Agree," the User agrees they are legally an adult (as stated by the law of their nation) and understands this license and it's consequences in full. Software Installations of Mikeware™ Information already have license agreements screen which conform to the above policy.

By "bookmarking" a Mature Content page the User agrees that anyone or anything accessing that link shall also be an adult and agrees to the terms and conditions stated in this license when accessing said bookmark.

Mikeware™ strives for quality software for everyone; however, occasionally there are themes and ideas that can only be expressed properly with more graphic content and themes. Unfortunately, such content restricts the available audience. Mikeware™ realizes that such Information is not suitable for all audiences and thusly has created the "Mature Content" license.

Mature Content is labeled as such because Mikeware™ feels that it is unsuitable or inappropriate for children. By accessing Mature Content you agree and realize that you are free to make your own decisions in life and shall not be influenced by any Violence, Language, Nudity, Themes, etc. in said Mature Content. You agree to release Mikeware™ from reliability and responsibility for any actions you may pursue in attempt or completion to imitate, act, role-play, etc. Mature Content Information in the Real World.

Anyone agreeing to this license, is also already held accountable for following Mikeware's distribution and application policy as per this license indicates already. In other words, distributing Mature Content to anyone else, especially non-adults is already prohibited. Also, allowing others than yourself to use Mikeware™ software means they also agree to this license (as per the Application section of this license). For the case of Mature Content, it ensures that the new User is also a legal adult.

In the case the Mature Content license is invalidated (knowingly or unknowingly) the original User of the Mikeware™ Mature Content Information agrees to take full responsibility for any outcome that may occur as a result of the invalidation. For example, a parent downloading Mikeware™ Mature Content to their computer and their child(ren) discovering it.

Epilepsy Warning: Very few (1 in 4000) User's can experience epileptic seizures while playing games with flashing lights and fast-moving images, even if there hasn't been a history before. If there is a history of Epilepsy in your family, or if you have previously had symptoms of Epilepsy consult a physician before playing. If you experience altered vision, convulsions, disorientation, dizziness, eye or muscle twitching, involuntary movement, or loss of awareness discontinue play immediately and consult your physician before resuming play.

License Modification: Mikeware™ retains the right to recreate, modify, or revoke this license at any time. The User agrees that in such an event, the new license will become active, replace the User's current license, and retroactively apply to any older licenses.
